Here are more Key Changes Under the New Renters’ Rights Bill you must know:

  • Mandatory Landlord Database:

    • Landlords must have an active entry on the database from the time the property is advertised until after the letting period ends.

    • The database will include details of landlords, properties, penalties, and banning orders.

    • Letting agents cannot let properties that are not on the database—doing so will be an offence.

  • Database Registration & Compliance:

    • All Rent Act 1977 tenancies and assured tenancies under the Housing Act 1988 must be registered.

    • Landlords can create an entry before full compliance and will have 28 days to meet all requirements (e.g., EPC, gas safety, electrical checks).

    • Keeping the database updated is mandatory (e.g., recording each new gas safety check).

  • Database Maintenance & Penalties:

    • Entries will be removed if inactive for five years (though "inactive" status is not clearly defined).

    • If a property has no gas supply, the electrical safety check might be the only required update over five years.

  • Consequences for Non-Compliance:

    • Landlords without an active database entry cannot seek possession, except under grounds 7A and 14.

    • Failure to maintain an active entry or include the unique identifier in advertisements can result in a £7,000 fine for a first offence.

    • Knowingly or recklessly providing false information can lead to penalties of up to £40,000.

    • Repeated offences or failure to comply beyond 28 days will also incur enhanced penalties.
